These terms and conditions govern your use of this Considered Style website; by using this website, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use the Considered Style website. Unless otherwise stated, Alex Smith or licensors of Alex Smith own all of the intellectual property rights arising from or in respect of the Considered Style website and material contained within it. You represent and warrant that any such submission by you will comply with those standards, and you indemnify Alex Smith/Considered Style for any breach of that representation or warranty.

The limitations and exclusions of liability set out in this Section and elsewhere in these terms and conditions: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the terms and conditions or in relation to the subject matter of the terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

To the extent permitted by law, neither Alex Smith nor Considered Style will be liable to you in respect of any losses arising out of any:

event or events beyond the reasonable control of Alex Smith and Considered Style;

business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill;

loss or corruption of any data, database or software;

special, indirect or consequential loss or damage; or

lack of availability of the Considered Style website at any time for any period of time.

 

(8) Indemnity

You hereby indemnify Alex Smith and Considered Style and undertake to keep them indemnified against any losses, damages, costs, liabilities and expenses (including without limitation, legal expenses and any amounts paid by them to a third party in settlement of a claim or dispute on the advice of their legal advisers) incurred or suffered by them arising out of any breach by you of any provision of these terms and conditions (including for the avoidance of doubt, your submission of your material in the Guest Book), or arising out of any claim that you have breached any provision of these terms and conditions.

Without prejudice to the other rights of Alex Smith and Considered Style under these terms and conditions, if you breach these terms and conditions in any way, Alex Smith and Considered Style may take such action as they deem appropriate to deal with the breach, including suspending your access to the Considered Style website, prohibiting you from accessing the Considered Style website, blocking computers using your IP address from accessing the Considered Style website, contacting your internet service provider to request that they block your access to the Considered Style website and/or bringing court proceedings against you.
